The Gearbox lawsuit against 3D Realms over the rights to make Duke Nukem games might finally be settled.
According to the settlement document, which was found by NeoGAF user Mr. Tibbs, it looks like the case was resolved in mediation earlier in the month. Although the terms of the settlement have not been released, it does appear that 3D Realms, which developed Duke Nukem 3D, will be able to buy back the rights to the IP from Gearbox.
The parties agree that the Seller may repurchase the Duke IP at a price equal to the Buy-Back.
Gearbox acquired the rights to Duke Nukem after 3D Realms ran into some financial issues and sold the rights to the IP to Gearbox, which finished production of Duke Nukem Forever. Gearbox filed a lawsuit against 3D Realms last year after Interceptor, the company that bought 3D Realms, teased a game called Duke Nukem: Mass Destruction.
Hopefully, this whole confusing situation will finally be put to rest. It will be interesting to see if 3D Realms and Interceptor will buy back the rights to create Duke Nukem games, or if Gearbox will end up keeping them. More importantly, do gamers even care for the Duke?
